Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorari, calling for the records relating to the I.D.No.468 of 1999 dated 25.05.2005 on the file of the first respondent and quash the same.

ORDER

This writ petition has been filed by M/s Tarapore & Company challenging the impugned award passed in I.D.No.468 of 1999 dated 25.5.2005 by the Second Additional Labour Court, Chennai, wherein the petitioner-company was directed to reinstate the second respondentMr.S.Krishna along with full backwages and continuity of service.

2. When the matter was taken up, both the parties have entered into an amicable settlement and filed a joint memo along with the memorandum of the terms of settlement reached under Section 18(1) of https://hcservices.ecourts.gov.in/hcservices/

the Industrial Disputes Act, 1947 read with Rule 25 of the Tamil Nadu Industrial Disputes Rules, 1958 dated 18th February, 2015 signed by the parties along with their respective counsel for a sum of Rs.4,00,000/- towards full and final settlement of the claim made in I.D.No.468 of 1999, which is the subject matter of challenge in W.P.No.3545 of 2006.

3. In view of the joint memo filed by both the petitioner and the second respondent along with the memorandum of terms of settlement reached under Section 18(1) of the Industrial Disputes Act, accepting the joint statement made by Mr.R.Parthiban, learned counsel for the petitioner and Mr.K.M.Ramesh, learned counsel for the second respondent that the matter has been settled between the parties and that the second respondent, who is also present in the Court, having received the said sum of Rs.4,00,000/- (Rupees four lakhs only) by cheque Nos.012338 & 012339 dated 17.2.2015 for Rs.2,00,000/- each drawn on Bank of India, Mount Road Branch, Chennai, the writ petition stands disposed of in terms of the joint memo and the memorandum of settlement dated 18th February, 2015, which shall form part of the record. No costs.
