The petitioner has come forward with this petition seeking for a direction, directing the respondent police to register a case, based on his complaint dated 02.01.2013 and to proceed further in accordance with law.
2. The learned counsel for the petitioner submitted that the petitioner has given a complaint to the respondent as early as on 02.10.2013 but, however, the respondents police had not taken any steps to register a case and hence, the petitioner has come forward with this petition for the above stated relief.
3. At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that on the basis of the complaint given by the petitioner against one Muthukumaran, enquiry has been conducted and in which, the said MuthuKumaran undertakes to repay the entire amount of Rs.3,09,000/-. On 22.01.2014, the said Muthukumaran has paid a sum of Rs.50,000/- and on 06.03.2014 he has paid another sum of Rs.50,000/- to the petitioner. Thereafter, he has not paid the balance amount. Therefore, the petitioner approached the respondent police and on enquiry, the said Muthukumaran undertakes to pay the balance https://hcservices.ecourts.gov.in/hcservices/
amount of Rs.1,50,000/- by monthly installments of Rs.5,000/-. Since the said statement was accepted by the petitioner, he has not pressed his complaint stating that no further action is necessary and hence, prays for dismissal of this petition.

Considering the rival submissions and also considering the fact that the since the petitioner has not pressed his complaint stating that no further action is necessary, this Criminal Original Petition is devoid of merits and therefore, this petition deserves to be dismissed. Accordingly, this Criminal Original Petition is dismissed.
