ORDER

This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner in respect of representation made by the petitioner on 12.10.2022 to the first respondent.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

3. It is seen from the representation of the petitioner that he had alleged about an enquiry made with regard to the dishonour of cheque. However, the learned Additional Public Prosecutor, on instructions, has submitted that a complaint under Section 138 of Negotiable Instruments Act, has already been filed and the same is pending in STC No.2257 of 2022 on the file of Fast Track Court, V Metropolitan Magistrate, Saidapet.

4. It is also seen that in view of the non-appearance of the petitioner before the learned V Metropolitan Magistrate, a bailable warrant has been

issued and only in view of that, the petitioner is being called by the police. Since it is a bailable offence and warrant also shows that it is bailable, it is upto the petitioner to make his appearance and get released by executing a bond for Rs.5,000/- along with sureties as stated in the bailable warrant.

5. In view of the above stated reasons, this Criminal Original Petition is disposed.
