(Order of the Court was made by the Hon'ble Chief Justice) The present application is filed for impleading the applicant as a party in the writ petition.

2. Mr.P.Wilson, learned Senior Counsel for the applicant submits that the applicant is the beneficiary of the proceedings. The land will be used for the benefit of the present applicant.

3. Mr.V.Raghavachari, learned Senior Counsel for the original writ petitioner submits that the beneficiary is the Highways Department and not the applicant.

4. Mr.P.Wilson, learned Senior Counsel, submits that the applicant is also ready to pay the amount for the superstructure subject to the petitioner proving his title.

5. According to the petitioners, the petitioners have a legal right to retain the property and they are occupying it for more than 93 years. The land in question is not the Government land.

6. Considering the nature of the dispute it would appear that the present applicant is a proper party. In light of that, the present applicant is permitted to be added as a respondent in the Writ Petition. The application is disposed of.
