CMP.No.23759 of 2024 in CRP.SR.No.118245 of 2024 P.B.BALAJI, J.

The petitioner had filed an appeal in unnumbered Appeal S.R.No.1066 of 2023 along with an application to condone the delay in I.A.No.1 of 2023 on the file of the Principal District Court, Salem. 2.The learned Principal District Judge, Salem, allowed the said application subject to conditions. However, for non-compliance of the conditional order, the said I.A. came to be dismissed.

3.The petitioner, in the affidavit filed in support of the present petition for condonation of delay, has stated that he was suffering from cancer and was unable to inform his counsel regarding the condition imposed by the Court for condonation of delay. The delay in preferring the appeal is only 11 days. 4.Heard the learned counsel for the petitioner. The sole respondent, though served, has neither chosen to appear in person nor through counsel.

5.Considering the reasons stated in the affidavit filed in support of the petition and being satisfied with the same, this Petition is allowed as prayed for. 03.02.2026 kv Note: Registry is directed to number the Civil Revision Petition, if the papers are otherwise in order and post the main case for admission.
