This petition is filed to set aside the ex parte order dated 14.08.2024, in which, the main appeal, i.e., C.M.A.No.1979 of 2023 was dismissed for non-prosecution.

Heard Ms.P.V.Preeja, learned counsel for the petitioner and Mr.C.C.Sivakumar, learned counsel for the respondent.

Having been satisfied with the reasons stated in the affidavit filed in support of this petition, we are inclined to allow this petition. Accordingly, this petition stands ordered and C.M.A.No.1979 of 2023 is restored on the file of this Court.

Post C.M.A.No.1979 of 2023 for hearing after two weeks.
