..Respondent(s) PRAYER : Review Application filed under Order 47 Rule 1 of CPC r/w Section 114 of CPC to review the judgement passed by the Honourable Division Bench of this Honourable Court in WA.No.217/2024 on 01-04-2024 and pass such further or other orders as this Honourable court may deem fit in the facts and circumstances of the case and thus render justice.

For Petitioner(s):

Mr. K.Thilageswaran For Respondent(s):

Mr.C.Kathiravan, Standing Counsel for R3

ORDER

(Order of the Court was made by S.M.Subramaniam J.) The learned counsel for the review petitioner would mainly contend that another Division Bench of the Madurai Bench of Madras High Court has taken a view in favour of the writ petitioner in W.A (MD) No.179 to 184 of 2025 by judgement dated 27.02.2025. However, it is brought to the notice of this Court that a Special Leave Petition in SLP No.71590 of 2025 has been preferred before the Hon'ble Supreme Court and it is pending. Therefore, relying on the above judgement, which is sub-judice before the Apex Court, the present review petition cannot be considered. That apart, the petitioner has not established any error apparent, except producing the judgement, which was subsequently passed by another Division Bench of Madurai Bench of Madras High Court. Any subsequent judgement would not constitute a ground to review the judgement already delivered by this Court.

2.

Accordingly, this review application is dismissed. No costs. (S.M.S.,J.) (M.S.Q.,J.) 05-06-2026 Index: Yes Speaking/Non-speaking order RKA
