PRAYER: Criminal Revision Petition is filed under Sections 438 r/w 442 of BNSS, praying to enhance the interim maintenance from Rs.4,000/- (Rupees Eight Thousand Only) each to Rs.30,000/- (Rupees Sixty Thousand only) to each of the 1st petitioners and the 2nd petitioners (minor child) as ordered in M.P.No.1278 of 2022 in M.C.No.455 of 2021 dated 09.09.2024. ORDER
The Criminal Revision Case has been filed seeking enhancement of interim maintenance awarded by the learned V Additional Principal Judge, Chennai vide order dated 09.09.2024 in M.P.No.1278 of 2022 in MC.No.455 of 2021.
2. Mrs.R.Ajitha, learned counsel for the petitioners submitted that she has no instructions from the petitioners and therefore had withdrawn the vakalat. A memo has also been filed to that effect.
3. Since this Court had asked the learned counsel to assist for disposal on merits, the learned counsel pointed out that the main MC was disposed on 31.12.2025 and produced the e-Courts case status to substantiate the same.
4. The Revision seeks enhancement of the interim maintenance and since the maintenance case itself has been disposed of on 31.12.2025, this Court is of the view that nothing survives for adjudication in this case and hence, this Criminal Revision Case is dismissed. 2/4
5. It is needless to say that if the petitioners are aggrieved by the quantum of maintenance awarded in M.C.No.455 of 2021, it is always open to them to challenge the same.
