O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to deal with the representation made by the petitioner on 17.07.2025 wherein the petitioner has sought for conducting enquiry under Section 36 of the Societies Registration Act, 1975 and to take action by holding proper election to the second respondent society.

2. Heard Mr.S.Rajeni Ramadass, learned counsel for petitioner and Mr.U.Baranidharan, learned Special Government Pleader appearing for first respondent.

3. Taking into consideration the facts and circumstances of the case and the grievance expressed by the petitioner questioning the 2/4

manner in which the election notification was issued and was later postponed and also considering the fact that several allegations were made against the second respondent, there shall be a direction to the first respondent to deal with the representation made by the second respondent on its own merits and in accordance with law and strictly in line with Section 36 of the Societies Registration Act, 1975, after affording opportunity to the second respondent and take a decision within a period of six (6) weeks from the date of receipt of a copy of this order. If the petitioner is so advised, it is left open to the petitioner to approach the civil Court to agitate the grievance. This writ petition is disposed of with the above direction. No costs.
