Contrary to the procedure, without the delay being condoned by an oversight, the Second Appeal had been numbered, as the condone delay petition was not brought to the notice of the Registry or the Court by the counsel. That apart, this appeal has been filed in the year 2019 and after the filing of the appeal, the 2nd respondent had died and his legal representatives had to be brought on record, which application was also taken out and the legal representative brought on record. In the process, the condone delay petition was overlooked. In order to keep the procedure straight, the delay is condoned, as it is only after the delay is condoned the appeal can be heard.
