O.A Nos.313, 314, 315 and 318 of in ELP No.11 of 2016 M.S.RAMESH.J In accordance with the decision of the Hon'ble Supreme Court reported in AIR 1982 SC page 983, the parties referred to under Section 82 of the Representation of the People Act 1951, alone can be impleaded as respondents and as such the Election Commission of India cannot be a necessary or proper party. Hence the present applications stand allowed. Consequently, the respondents 25 to 28 are struck off from the Election Petition No.11 of 2016.
