The 1st respondent was convicted vide judgment, dated 01.07.2022 in S.T.C.No.57 of 2019 by the learned Judicial Magistrate, Fast Track Court at Magisterial Level, Coonoor (Trial Court) for offence under Section 138 of the Negotiable Instruments Act, 1881 and sentenced to undergo Simple Imprisonment for six months and to pay a fine of Rs.12,50,000/- as compensation to the petitioner in default to undergo two months Simple Imprisonment. Aggrieved over the same, the 1st respondent preferred an appeal before the learned Sessions Judge, Magalir Neethimandram (FTMC), Udhagamandalam in Crl.A.No.23 of 2022 and the same was allowed setting aside the judgment of the Trial Court. Challenging the same, the present criminal revision case and the leave grant petition filed by the petitioner. 2.Finding two contra judgments passed by the Courts below, this Court is inclined to grant leave.
