O R D E R

The revision petitioner herein is the plaintiff in the suit in O.S.No.103 of 2015 on the file of District Munsif, Mannargudi filed for the relief of permanent injunction and he filed this Civil Revision Petition seeking a direction directing the learned District Munsif, Mannargudi to dispose the suit within a stipulated period.

2. The reasons assigned by the Revision Petitioner is that he filed a suit for permanent injunction against the respondents in respect of the suit property measuring an extent of 1 acre 47 cents. The respondents have protracted the proceedings for the past 8 years, however, evidence of plaintiff's side was closed long back and the suit is now posted on 08.09.2023 as last chance. Though the defendants have filed written statement as early as on 28.09.2015, till date, there is no progress in the trial. E-court status from the year of 2015 also produced and the case is posted for evidence, but till date it was not disposed of by the trial judge. 2/4

On considering the fact that the suit was filed seeking for permanent injunction and the plaintiff, being a woman, she approached the court and for the past 8 years, the respondents have protracted the proceedings and also on considering the reasons assigned by the Revision Petitioner justifiable one, this Court is inclined to direct trial judge to dispose the suit in O.S.No. 103 of 2015 within a period of three months from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is allowed. No costs.
