Respondent(s) PRAYER: The Writ petition has been filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to pay the difference/arrears of wages for the period from

01.09.2019 to 31.05.2022 and also to pay terminal benefits namely Gratuity, Encasement of Leave, Provident Fund, Pension Arrears and to revise pension on the basis of 12 (3) settlement dated 24.08.2022 along with 12% interest p.a. within a time frame as may be fixed by this Court. ORDER

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

The instant writ petition has been filed with a prayer for issuing a Mandamus directing the respondents to pay the difference/arrears of wages for the period from 01.09.2019 to 31.05.2022 and also to pay terminal benefits namely Gratuity, Encasement of Leave, Provident Fund, Pension Arrears and to revise pension on the basis of 12 (3) settlement dated 24.08.2022 along with 12% interest per annum within a time frame as may be fixed by this Court.

3. Heard the learned counsel for both sides and perused the materials available on record.

4. The learned counsel for the petitioner would submit that the petitioner has sent a representation dated 22.02.2025 claiming the difference/arrears of wages and to pay terminal benefits on the basis of 12 (3) settlement dated 24.08.2022, and such representation is pending with the first respondent.

4. At this juncture, the learned Standing Counsel appearing for the respondents would fairly submit they will pay eligible amount within a reasonable time.

5. In view of the above submission, without going to merits of this Writ Petition, this Court deems it appropriate to direct the respondents to settle the eligible amount along with interest at the rate of 6% per annum upon the delayed payment of retirement benefits, from the date of retirement till the date

of actual disbursal of the terminal benefits to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.

6. In the result, this Writ Petition is disposed of with the above directions. No costs.
