ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 26.07.2020 for the offences under Section 8(c), 20(b)(ii)(C), 25, and 29(1) NDPS Act 1985 in Crime No.773 of 2020 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that based on the secret information that ravi was selling Ganja near Iyyappanthangal, subrmaniya nagar, the respondent police went to the scene of occurrence where there two persons noticing the police trying to escape from the spot, at that time the respondent police stopped them, on enquiry the respondent police found 1 Kg and 30 kgs of Ganja, from his scooter and house respectively and seized the same. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that he has been suffering incarceration for more than one year. Hence prays for grant of bail. 4.The learned Government Advocate (Crl.Side) submitted that the petitioner was found in illegal possession of 31 Kgs of Ganja. He further submitted that it is a commercial quantity. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the gravity of offence committed by the petitioner and it is commercial quantity and there is no change of circumstance, this court is not inclined to grant bail to the petitioner.
