PRAYER This Criminal Original Petition has been filed under Section 528 of BNSS to direct the Respondent No.2 police to execute the Non-bailable warrant issued by the Honble Metropolitan Magistrate, Fast Track Court-II (At Metropolitan Magisterial Level) Allikulam, Egmore in STC/PC/No.9710 of 2023 dated 09.07.2025 against Respondent No.3 and also based on the petitioner's representation dated 18.07.2025 and pass suitable order as deem fit and proper in the circumstance of the case and thus render justice. ORDER

This Criminal Original Petition has been filed seeking direction to the 2 nd respondent police to execute the non-bailable warrant against the 3 rd respondent/accused.

2. The contention of the petitioner is that the 3 rd respondent/accused was sentenced to undergo simple imprisonment for one year for the offence under Section 138 of NI Act and was also directed to pay a sum of Rs.8,72,641/- as compensation, by the Metropolitan Magistrate, Fast Track Court at Magisterial Level-II, Egmore @ Allikulam in STC No.9710 of 2023.

3. The grievance of the petitioner is that despite the conviction warrant issued by the Trial Court on 09.07.2025, the same has not been executed so far.

4. The learned Government Advocate, (crl. Side) appearing for the respondents 1 and 2 would submit that the respondents have not yet received the warrant. They will verify with the Trial Court regarding issuance of the warrant and take necessary action to execute the same as expeditiously as possible.

5. Considering the submission made by the learned Government Advocate(crl.side), the 2 nd respondent police is directed to execute the warrant as expeditiously as possible in accordance with law. 3/5

6. With the above direction, this Criminal Original Petition is disposed of.
