On representation of the learned counsel on either side, this case is taken up for settlement before the Lok Adalat. Mr.Arun Kumar, learned counsel for the appellant and Mr.J.Ram, learned counsel for the respondents are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.6,72,800/-with interest at 7.5% per annum from the date of petition till the date of deposit with costs as compensation.

2.The appellant and the 1st respondent are present along with their Advocates. The parties are ready to settle the matter for Rs.4,66,940/- (Rupees Four Lakhs Sixty six thousand Nine hundred and Forty only) as full quit.

4.It is submitted that the appellant has already deposited the settled amount of Rs.4,66,940/- (Rupees Four Lakhs Sixty six thousand Nine hundred and Forty only) to the credit of M.C.O.P.No.58 of 2012 on the file of the Motor Accidents Claims Tribunal, (Principal Subordinate Judge) Chengalpattu. The 1st respondent is permitted to withdraw the amount lying in the deposit of M.C.O.P.No.58 of 2012 by filing an appropriate application before the lower Court. 5.The Civil Miscellaneous Appeal stands disposed of as settled in the above terms.

The Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
