ORDER

This writ petition has been filed to direct the respondents 1 and 2 to consider the petitioner's representation dated 21.08.2024.

2. The learned counsel for the petitioner would submit that in this case, a representation was filed by the petitioner to survey and measure the property of the petitioner in S.No.121/11 covered in patta No.1089 of Avadaiyarpattu Village, Vikravandi taluk and thereby direct the respondents to take action against all the concerned in accordance with law from using the above said

petitioners property as a place of worship and to remove all the idols illegally installed in the property of the petitioner. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned counsel for the respondent would submit that the petitioner's representation will be disposed of by the respondent within a period of 8 weeks.

4. Heard the learned counsel appearing for the petitioner and the respondent and also perused the entire materials available on record.

5. In view of the above, without expressing any opinion on the merits of the matter, this Court directs the respondent to consider the representation of the petitioner dated 21.08.2024 and after issuing notice to all the rival parties, dispose of the same, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order.

6. It is made clear that this Court is not issuing any direction with regard to the removal of statue in the subject land. The duty of the official respondents is only to measure the subject land and lay survey stones therein. If there is any dispute with regard to the title of the property, the Authorities concerned shall not proceed with the process of measuring the subject land. It is up to the

concerned parties to approach a Civil Court and establish their rights over the said property.
