O R D E R

This writ petition is filed for issuance of Writ of Mandamus, directing the 1st respondent to dispose of the petitioner's Appeal No.3593/E2/2022, dated 02.08.2022 on the file of the 1st respondent within a stipulated time as prescribed by this Court.

According to the petitioner, originally the property comprised in Old Survey No.14/1, New Survey No.1283/14 situated at Thirumalayampalayam, Madukkarai Taluk, belongs to his grandmother by virtue of registered sale deed in Doc.No.758/1945 on the file of the Sub Registrar Office, Joint-II, Coimbatore and she has been in possession and enjoyment of the property. After the demise of his grand parents, the respondent Nos. 2, 3 and 6 have executed a registered partition deed vide in Doc.No.747 of 2020 on the file of Sub Registrar Office, Madhukkarai, with regard to their mother Doc.No.232/2012. Aggrieved by the same, the petitioner sought for cancellation of Doc.No.747 of 2020 before the District Registrar, Coimbatore and the same was dismissed on 31.05.2022. Against which, the petitioner preferred an appeal before the first respondent on 02.08.2022, till date, the 1st respondent has not passed any order on the appeal preferred by the petitioner. Hence this petition.

3. Heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the 1st respondent and perused the materials available on record.

Having regard to the limited scope of the prayer, this Court is inclined to pass the following order:- The petitioner is hereby directed to submit an application before the District Registrar, Coimbatore, to dispose of the Appeal No.3593/E2/2022, dated 02.08.2022 within a period of six weeks from the date of receipt of a copy of this order.

5. Accordingly, the Writ Petition is disposed of . No costs. 20.10.2022 Index : Yes / No Speaking order : Yes / No msm To The Deputy Inspector General Registration Department Coimbatore.
