Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the respondents 3 and 4 to remove the encroachment made in the property comprised of T.S.No.238, measuring about 0.8918.5 square meter of land situated at Block No.19, Ward - K, Periyeri Village, Salem Taluk, Salem District and further directing the respondents 5, 7 and 8 to give proper police protection for

removal of the illegal encroachments from the said property. For Petitioner :

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) On a perusal of the petition, we find that the District Collector, Salem by letter dated 17.10.2016 has already asked the Revenue Divisional Officer, Salem to take necessary action and thus, there is no reason for the petitioner to rush to the Court at this stage. We would expect the Revenue Divisional Officer, Salem to take action in terms of the communication of the District Collector, Salem.

2. If there is a prolonged inaction, it is always open to the petitioner to approach the Court.

3. The writ petition is dismissed in terms aforesaid. No costs.
