2.Heard the learned counsel for the petitioner/appellant and the learned counsel for respondent-1.

3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is ordered and S.A.No.620 of 2007 is restored to file.

4.The Registry is directed to post the Second Appeal on 07.03.2023 "for arguments".
