ORDER

The above writ petition is filed for issuance of a writ of mandamus, directing respondents to make the payment for the work (2020-2021 Construction of Amma Mini Clinic at Ward Nos. 34 to 48 in the Zone - 4) executed by the petitioners based on the proceedings of the respondents dated 05.11.2024, and the representations of the petitioners dated 26.02.2024, 24.10.2024 and 26.06.2025.

2. The petitioners who are registered contractors under the respondent Corporation, are said to have executed several works in the past 15 years, without any adverse records. The petitioners states that during Covid pandemic, the respondents sent a proposal to the Government for approval of a short tender notice for the period 2020-2021, for construction of Mini Clinic at Ward Nos. 34 to 48 in the Zone-4, in the name of Amma Mini Clinic. The petitioners further state that since the State Assembly Elections were announced, in terms of the electoral protocol, no tender notification was issued by the respondents for construction of Mini Clinic. The petitioners states that oral work orders were issued and based on the oral work orders, the works were successfully completed without any default.

The petitioners states that on successful completion of the work, the respondents inspected the sites, confirmed the quality and stability of the construction, and entered the particulars of work executed in M-Book, maintained for the purpose. The petitioners raised the bill for the works successfully completed and put to public use, but for the reasons best known to the respondents, the bill amounts were not settled. The petitioners therefore submitted multiple representations on 26.02.

24.10.2024 and 26.06.2025, for payment of their bills. Since, there was no response from the respondents, the petitioners filed the above writ petition for the aforesaid relief.

3. I heard both the learned counsels and perused the materials placed on record. With the consent of both the learned counsels the main writ petition is taken up for final disposal.

4. Under the facts and circumstances of the case, and without going into the merits of the matter, this Court is inclined to direct the 1 st respondent, to consider the petitioner's representations dated 26.02.2024, 24.10.2024 and 26.06.2025, and pass orders on merits and in accordance with law, within a period of twelve (12) weeks, from the date of receipt of a copy of this order. Writ petition is accordingly disposed of. However there shall be no order as to costs.
