A.Nos.4926, 4927 and 4928 of 2021 in Tr CS No.352 and 362 of 2012 and T.O.S.No.33 of 2011 G.CHANDRASEKHARAN.,J A.Nos.4926 of 2021, 4927 of 2021 and 4928 of 2021 filed for condoing the delay of 170 days in filing the application to set aside abatement of the deceased 6th defendant, setting aside abatement and to bring the legal heirs of 6th defendant on record are pending and posted for filing counter of the respondent today. Counter of the respondent has not been filed. 2.

It is submitted by the learned counsel for applicant that 6th defendant died during the Covid period on 28.06.2020 and therefore, her husband was not in a position to intimate the death of 6th defendant to the counsel appearing for the applicant. This is the reason for the delay.

Considering the reason stated for the delay of filing the application and the impleadment of the legal representative of the 6th defendant is absolutely necessary for proceeding further with the suit, this Court allows all these applications. The plaintiff is directed to take appropriate steps to amend the plaint. Post the matter after two weeks.
