The petitioner, who apprehend arrest for the alleged offences under Sections 8(c) and 20(b)(ii)(c) of NDPS Act, 1985 in Crime No.490 of 2022 on the file of the respondent police, seeks Anticipatory Bail.

2. The case of the prosecution is that the petitioner along with other accused persons were found in illegal possession of 44 Kgs of Ganja in Polythin Bag. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the earlier anticipatory bail applications were dismissed by this Court on various dates. Therefore, he prays to grant anticipatory bail to the petitioner. 1/3

4. On a perusal of the records, it is seen that this Court had already dismissed the Anticipatory Bail filed by the petitioner in Crl.O.P.No.8234 of 2023 by order dated 05.06.2023. In fact, the said application was filed suppressing the earlier application filed before this Court in Crl.O.P.No.15454 of 2022 and the same was dismissed on 05.07.2022. That apart, the petitioner along with other accused persons were found to be in illegal possession of 44 Kgs of Ganja and there are totally 3 accused in this case, in which the petitioner is arrayed as A3.

5. Though, this Court had previously dismissed the Anticipatory Bail for three times, the petitioner is again approaching this Court without surrendering before the respondent police.

6. Considering the above facts and circumstances of the case, there is no change of circumstances, this Court is not inclined to grant Anticipatory Bail. Accordingly, this Criminal Original Petition stands dismissed. 11.10.2023 skr 2/3
