O R D E R

This Criminal Revision has been filed by the petitioner, to set aside the order dated 04.11.2017 passed by the learned Chief Judicial Magistrate, Tiruppur, in MC.No.26 of 2012. By the impugned order, the learned Magistrate directed the petitioner to pay a monthly maintenance of Rs.10,000/- from the date of filing of the maintenance case, to the second respondent and continue to pay the said sum on or before 5th of every succeeding English calender month, besides granting Rs.7,500/- for DNA test and Rs.25,000/- towards litigation expenses to the first respondent.

2.Today, when the matter was taken up for consideration, the learned counsel for the petitioner submitted that pursuant to the order dated 13.06.2018, made in Crl.MP.No.6514 of 2018, the petitioner has deposited a sum of Rs.5,00,000/- by way of D.D. bearing No.500626 dated 04.04.2018, which was received by the learned Chief Judicial Magistrate, Tiruppur, on 22.06.2018. The learned counsel further produced a copy of the death certificate of the petitioner and submitted that the petitioner is no more and hence, this petition may be closed. https://hcservices.ecourts.gov.in/hcservices/

3.Conceding the submissions so made by the learned counsel for the petitioner, the learned counsel for the respondents submitted that the second respondent may be given permission to withdraw the aforesaid amount deposited by the petitioner before the Court below.

4.Recording the aforesaid submissions made by the learned counsel for the petitioner, this Criminal Revision Case stands closed. Permission is granted to the second respondent for withdrawal of the amount lying in the deposit before the Court below. Consequently, connected Miscellaneous Petitions are also closed.
