PRAYER :
Petition under Section 11 of the Contempt of Courts Act,1971, to punish the respondents for wilful disobedience of the order of this Court, dated 09.12.2024, passed in W.P.No.11518 of 2019. For Petitioner : Mr.C.V.Vijayakumar For Respondents : Mr.T.Chandrasekaran, Special Government Pleader.
ORDER
This Contempt Petition is filed, alleging wilful disobedience in complying with the order of this Court, dated 09.12.2024, passed in W.P.No.11518 of 2019.
2. Heard the learned counsel for the petitioner and the learned Special Government Pleader, appearing for the respondents, and also perused the records.

When the Contempt Petition is taken up for hearing, learned Special Government Pleader, appearing on behalf of the respondents, has placed before this Court the written instructions, as furnished to him by the District Backward Classes and Minorities Welfare Officer, Kancheepuram, under the cover of letter, dated 22.10.2025, along with enclosures, wherein in the communication from the Additional Commissioner (Revenue
Administration), Chepauk, Chennai, to the Accountant General, Chennai, it is stated as under :
"7. The above official is fully entitled for grant of pension and gratuity under the Tamil Nadu Pension Rules,1978. The pensionary benefits and commuted value may be assessed and a copy of your assessment report along with the approved pension calculation sheet may be sent to this office.''

Learned Special Government Pleader submits that this Court, while setting aside the impugned order, dated 06.06.2016 and 30.01.2017, passed by the first and the third respondent respectively, directed the respondents to fix the regular pension for the petitioner forthwith, considering his request for regularisation of his suspension period from 26.07.1999 to 31.05.2001 and that the respondent authorities have fixed the pension, by regularising the suspension period from 26.07.1999 to 31.05.2001, as directed by this Court.

The learned Special Government Pleader further submits that the respondents have thus complied with the orders of this Court and the petitioner has been paid the retirement gratuity amount of Rs.11,883/- through ECS on 26.11.2025 and the pension amount has been approved by the Assistant Treasury Officer, Tindivanam, on 25.11.2025, by fixing monthly pay of Rs.47,890/-.
6. Stating as above, the learned Special Government Pleader has placed before this Court a copy of the proceedings of the Assistant Treasury Officer, Tindivanam, and submitted that the respondents have now complied with the orders of this Court.
7. Learned counsel for the petitioner, however, submits that the aforesaid calculation, as made by the respondents, is incorrect.
8. It is to be noted that since, the respondents have complied with the order passed by this Court by fixing the pension payable to the petitioner and also having issued the proceedings, dated 25.11.2025, this Court is of the view that the respondents have substantially complied with the order passed by this Court. However, if the petitioner has any grievance with regard to the amount of pension fixed by the respondents under the above mentioned proceedings, it is open for him to work out his remedies, by approaching the appropriate authority or taking further action in accordance with law.
9. Subject to the above observations, this Contempt Petition is closed.
