JUDGMENT

(Judgment of the Court was delivered by S.M.Subramaniam J.) Writ order dated 08.04.2022 in W.P.No.40885 of 2015 is under challenge in writ appeal.

2. Writ petitioner is the appellant before this Court. Petitioner was serving in Tamil Nadu State Transport Corporation (Coimbatore limit) and he was dismissed from service on 24.10.2001 through departmental disciplinary proceedings. Appellant challenged the order of dismissal by rising a dispute in ID.No.139 of 2002, which was allowed by the Labour Court vide Award dated 09.07.2008. However, management preferred an appeal before the High Court and by order dated 22.09.2014, High Court set aside the Award and confirmed the order of dismissal issued by the Management. A dismissed employee is not entitled for pension under Rule 21(a) of the Tamil Nadu State Transport Corporation Employees' Pension Fund Rules. Dismissal from service amounts to forfeiture of past services under the Rules.

3. That being the legal position, the Writ Court has rightly dismissed the writ petition. Consequently, the writ order dated 08.04.2022 in W.P.No.40885 of 2015 is confirmed and the Writ Appeal stands dismissed. No costs.
