The learned counsel for the respondents would object for condoning the delay mainly on the ground that the reasons stated in the affidavit filed by the petitioner are insufficient. However, this court is of the considered opinion that, since it is a First Appeal, an opportunity is to be provided to the appellant to adjudicate the issues on merits.

2. Taking note of the fact that it is a First Appeal wherein some amount of leniency is required for condoning the delay, the delay of 311 days in filing the writ appeal, is condoned.

3. Accordingly, the Civil Miscellaneous Petition is ordered.
