ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(c) and 24(1) of Tamilnadu Prohibition Act 2024, in Crime No.530 of 2025 on the file of the respondent police, seeks anticipatory bail.

The prosecution alleges that on July, 19, 2025, Vijay Hotels contravened the statutory regulations by selling liquor, to guests beyond the stipulated hours, specifically after midnight, prompting the registration of a case against the petitioners as the license holder and manager of the establishment.
3. The learned counsel appearing for petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

The learned Government Advocate (Crl. Side) appearing for the respondent police, while opposing the grant of anticipatory bail to the petitioners, reiterated the prosecution case and submitted that there are totally
two petitioners arrayed in this case and the petitioners are arrayed as A1 and A2. 5.
Taking note of the facts and circumstances of the case, the nature of allegations, and since, custodial interrogation is not required for the purpose of investigation, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Judicial Magistrate-II, Coimbatore, on condition that the petitioners shall execute a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that: (a) the petitioners are directed to deposit a sum of Rs.10,000/- each (Rupees Ten Thousand only) to the credit of Sevalaya, No.F-2, Pushkarani Apartment, 12 Ananda Road, Alwarpet, Chennait-600 018, Account Name: SEVALAYA,
A/C No.218601000134, ICICI Bank, Mylapore Branch, Cheanni-600 004, IFSC ICIC0002186, Cell No.9941450444, within a period of two weeks from the date of receipt of a copy of this order and shall produce the receipt for the same before the Court below.
(b) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(c) the petitioners shall report before the respondent police on alternative days at 10.30 a.m. for the period of three months.
(d) the petitioners shall not tamper with evidence or witness either during investigation or trial;
(e) the petitioners shall not abscond either during investigation or trial;
(f) on breach of any of the aforesaid conditions, the learned
Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(g) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
