ORDER

The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 420, 465, 468 and 471 of IPC, in Crime No.73 of 2025, seeks anticipatory bail.

2. The allegation against the petitioner is that the defacto

complainant has approached A1, who is the father of the A2, for obtaining the loan of Rs.3 lakhs and handed over the documents to them. Taking advantage of the possession of the documents, A1 and the petitioner/A2 along with other accused, created the death certificate of the original owner, fabricated the legal heir certificate, and sold the property to third parties, thereby cheated the defacto complainant. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is the son of A1 and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that the investigation is not completed and the petitioner is one of the main accused. He further submitted that A3 alone was arrested and released on mandatory bail.

5. The learned counsel for the intervener submitted that the petitioner fabricated the documents and sold to A3 and A1 is still absconding.

6. Heard the learned counsel for the petitioner and the learned

Government Advocate (Crl.Side) and perused the materials available on record.

7. Considering the fact that this petitioner activitely participated in the fabrication of death certificate, legal heir certificate and subsequently sold the property based on these documents, this Court is not inclined to grant anticipatory bail to the petitioner.
