This Criminal Original Petition is filed to quash the FIR registered against these petitioners for the offence under Sections 498A, 406, 494 & 506(i) IPC and Section 4 of Dowry Prohibition Act. 2.

The learned counsel appearing for the petitioners submits that the petitioners are in-laws of the complainant and the communication between the complainant and her husband would clearly show that it is a personal matter and these petitioners are no way connected with the alleged offences.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that apart from dowry harassment, there is a specific allegation made against these petitioners that, when the first marriage with the defacto complainant is in force, they have arranged the second marriage to one Mohanapriya. Therefore, investigation has to be conducted regarding the role of these petitioners in the alleged crime. 2/4

Taking note of the fact that apart from allegations of cruelty and harassment, abetment to solemnize the second marriage, when the first marriage is in force, need to be investigated in the manner known to law. Therefore, this Criminal Original Petition to quash is dismissed.
