Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, Directing the 1st to 3rd respondents to consider petitioner representation dated 08.07.2023 and direct the 2nd respondent to refund Caution fee of Rs. 1,00,000/- and Tuition fee of Rs. 15,20,000/- within the time frame stipulated by this Honble Court.

O R D E R

This Writ Petition has been filed for a direction directing the respondents 1 to 3 to consider the representation submitted by the petitioner dated 08.07.2023 seeking refund of the Caution Deposit of Rs.1,00,000/- and the Tuition fee of Rs.15,20,000/-.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner completed her Higher Secondary Examination and 2/6

appeared for the National Eligibility cum Entrance Test (NEET) with the objective of securing admission to the MBBS course. She qualified in the said examination and was subsequently offered admission to the MBBS course at the 4th respondent college under the Management Quota for the academic session 2022-23. Thereafter, she paid the Caution Deposit of Rs.1,01,000/- and the Tuition fee of Rs.10,20,000/- through online and obtained a demand letter dated 09.12.2022.

4. Before initiating the admission process, the authorities of the 4th respondent college demanded an additional fee of Rs. 3,50,000/- from the petitioner. This amount was in addition to the fee as notified by the selection committee vide letter dated 12.12.2022 and the petitioner was required to pay the said amount every year. Therefore, due to this additional demand, the petitioner was not interested in pursuing the MBBS Course in the 4th respondent college and returned without completing the admission process. Thereafter, the petitioner's father sent several complaints through e-mail as well as registered post. However, no action was taken on the said complaints. Hence, the petitioner submitted a detailed representation dated 08.07.2023 to the respondents 1 to 3 seeking refund of the Caution deposit and the Tuition fee already paid. However, till date no 3/6

action has been taken by the respondents 1 to 3.

5. Admittedly, due to the demand for an additional fee of Rs.3,50,000/- the petitioner did not join the 4th respondent college. Subsequently, the petitioner seat was also filled up by another candidate. As per the Notification issued by the UGC dated 23.04.2007, in the event of student/candidate withdrawing before the starting of the Course, the waitlisted candidates should be given admission against the vacant seat. The entire fee collected from the student, after a deduction of the processing fee of not more than Rs.1,000/- shall be refunded and returned by the Institution/University to the student/candidate withdrawing from the Programme.

6. Therefore, the petitioner is entitled for the refund of the Caution deposit as well as the Tuition fee since she did not join the 4th respondent college and she had withdrawn her candidature. That apart, already the petitioner's seat was filled up by another candidate. Hence, there is no loss to the respondents.

7. In view of the above, the 2nd respondent is directed to refund the 4/6

Caution deposit of Rs.1,00,000/- and Tuition fee of Rs.15,20,000/- to the petitioner within a period of 4 weeks from the date of receipt of a copy of this order.

8. With the above direction, the Writ Petition is allowed.
