ORDER

This Criminal Original Petition has been filed to direct the second respondent to grant police protection to the petitioner.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2.

3. The learned counsel for the petitioner submitted that the petitioner was in possession and enjoyment of the land in S.No.794/1 to an extent of 1 acre which was purchased from the third respondent in the year 2012; when he attempted to plough the land to cultivate plantain crop, the private respondents stopped the petitioner from cultivating the land and threatened him seeking additional amount for the sale took place in the year 2012. Hence the petitioner made a complaint on 08.09.2022 against the private respondents.

4. The learned Additional Public Prosecutor appearing for the respondents 1 and 2 submitted that on the complaint given by the petitioner on 08.09.2022, the case has been taken on file in CSR No.587 of 2022 and

enquiry has been conducted and the same has been closed on 08.09.2022.

5. The cause of action that has arisen in this petition is purely a civil in nature. So it is upto the petitioner to approach the appropriate Civil Court to obtain an order in his favour. Without the order or decree from the Civil Court, the petitioner cannot seek any police protection. So the relief sought for by the petitioner cannot be granted.

6. In the result, this Criminal Original Petition is disposed of. However, the petitioner is at liberty to seek appropriate remedy before the appropriate Court.
