The petitioner, who apprehends arrest for the alleged offence under Sections 406, 420 and 506 (ii) of IPC in Cr.No.09 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner herein along with other accused conducted Deepavali Chit in their village and collected to the tune of Rs.36,00,000/- and when it was demanded by the defacto complainant and others for the return of their amount, the petitioner herein not repaid the same and sought time for the repayment. The petitioner herein threatened them with dire consequences. Hence, the Law Enforcing Agency registered a case against the petitioner.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence prays for grant of anticipatory bail.

dk 4.The learned Government Advocate (Crl.Side) submitted that the petitioner had misappropriated a sum of Rs.41,06,500/- from different persons. He further submitted that total number of victims are 93. Hence, he opposed to grant anticipatory bail to the petitioner.

5. As per the submission of the learned Government advocate(Crl. Side), the petitioner had cheated more than forty lakhs from the victims. Further, the petitioner had filed an Insolvency Petition before the Subordinate Court, Villupuram. Therefore, the custodial interrogation of the petitioner is required in this case. Hence, this court is not inclined to grant anticipatory bail to the petitioner.
