The petitioner herein, alleging that the police is harassing him on the complaint given by his wife, is before this Court seeking protection from harassment.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that on the complaint given by the petitioner's wife, C.S.R.No.840 of 2023 was registered. The petitioner was called for enquiry regarding 4 sovereign of gold jewel of the complainant retained by the him and the petitioner admitting that holding of 4 sovereign of the complainant jewel has promised to return on 18.08.2024. Based on his undertaking, complaint has been closed. However, on 18.08.2024, the petitioner had failed to give back the jewel, who has come before this Court alleging that police is harassing him.

Considering the fact if the investigation by the police in C.S.R.No.840 of 2024 disclose misappropriation of jewel of the complainant and not been returned, it is open to the respondent police to register the FIR and proceed against the petitioner. 4.

With the above observation, this Criminal Original Petition is disposed of.
