O R D E R
The petitioner has come forward with this petition seeking for a direction, directing against the second respondent to register the petitioner's complaint dated 08.05.2015.
2. The learned counsel for the petitioner submitted that the petitioner has given a complaint to the first respondent on 08.05.2015. But, however, the first respondent police had not taken any steps to investigate the matter and register a case. Hence, the petitioner has come forward with this petition for the above stated relief. Subsequently, second respondent has been impleaded. Now the petitioner sought for direction to the second respondent to register the case on the basis of the complaint received by him through the first respondent and prayed for the above stated relief. https://hcservices.ecourts.gov.in/hcservices/
3.Resisting the same, the learned Government Advocate (Crl. Side), on instructions, would submit that the first respondent received the petitioner's complaint dated 08.05.2015, which was forwarded to the second respondent, in Current Paper No.451 of 2015, petition enquiry is going on.
4. Considering the rival submissions made on both sides, on the basis of the complaint made by the petitioner, as enquiry is going on in Current Paper No.451 of 2015, the second respondent is directed to expedite the enquiry and follow the dictum laid down in Lalitha Kumari vs. Govt. of U.P & others [2013 (4) Crimes 243 (SC) and register a case, if any cognizable offence is made out.
5. The Criminal Original Petition is disposed of with the above direction.
