Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certioraified Mandamus, to call for the records relating to the impugned order of the 2nd respondent issued in R.No.2683/2025/S12/FSD dated 22.07.2025 and quash the same and consequently direct the 2nd respondent to issue a Charge Memorandum to the petitioner, if necessary, and thereby finalise the proceedings within a period of six months, by treating the period of Suspension as a Duty. The instant writ petition has been filed to call for the records relating to the impugned order of the 2nd respondent issued in R.No.2683/2025/S12/FSD dated 22.07.2025 and quash the same and consequently direct the 2nd respondent to issue a Charge Memorandum to the petitioner, if necessary, and thereby finalise the proceedings within a period of six months, by treating the period of Suspension as a Duty.
2. Though the learned counsel for the petitioner has seriously disputes the impugned suspension order dated 22.07.2025 on various grounds, he has 2/5
restricted his prayer that the respondents to conclude the disciplinary proceedings within a period of six months, he would satisfy the petitioner.
3. In view of the aforesaid submission made by the learned counsel for the petitioner, without going into the merits of the case, this Court deems it appropriate to direct the respondents to conclude the disciplinary proceedings initiated against the petitioner within a period of six(6) months from the date of receipt of a copy of this order. Further, the petitioner is also granted liberty to give a representation to review the suspension within a period of one(1) month from the date of receipt of a copy of this order. If such representation is received, the respondent is directed to consider the same and find out the possibilities to accommodate the petitioner in a Non-sensitive post in the parent department, according to its own merits and in accordance with law.
4. With the above directions, this Writ Petition is disposed of. No costs. Consequently connected miscellaneous petitions are closed. 30.07.2025 msv Index : Yes/No Speaking order /Non Speaking Order 3/5
