Respondents Prayer:- Writ Petition has been filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the 2nd respondent to condone the lack of attendance of the petitioner in the 7th Semester taken into consideration the extra ordinary factual reasons and allow the petitioner to continue the Final Year B.E.Mechanical Engineering with the 3rd respondent in this Academic Year itself.

O R D E R

Though the petitioner is studying in the 3rd respondent College and undergoing B.E. Mechanical Engineering course, he was not allowed to write the 7th semester examination due to lack of attendance, i.e. minimum 75% attendance.

It is submitted by the learned counsel for the 3rd respondent College that the petitioner has secured only 57.94% attendance as against 75% and even if his absence is condoned, the minimum required attendance is 65%. Therefore, it is not possible for the respondents to allow the petitioner to write the examination and he has to re-do the 7th semester by attending the classes.

3. When the rules are very clear stating that requirement of 75% attendance is must for writing the examination, the same cannot be violated. Therefore, the relief sought for by the petitioner cannot be granted and the petitioner has to continue classes in the same semester and secure the minimum attendance required. Thereafter only, he could write the examination for the 7th semester. Hence, the writ petition fails.

4. In the result, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
