Crl.O.P.No.7750 of 2016 K.KALYANASUNDARAM,J., The petitioner, who is arrayed as A4 apprehends arrest at the hands of the respondent police for the alleged offence under Section 380 IPC in Crime No.26 of 2016 and hence, seeks anticipatory bail.

2. The case of the prosecution is that on 26.03.2016, the petitioner along with other accused had trespassed into the premises of the defacto complainant and committed theft of electronic articles.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and his name was implicated wrongly in this crime, on the basis of the confession statement given by the coaccused.

4. The learned Government Advocate (Crl.side) would submit that the petitioner is having one previous case in similar in Cr.No.35 of 2009 and the respondent police have taken finger prints from the place of occurrence and unless the petitioner is secured, the investigation may not be effected successfully.

5. Considering the above facts and circumstances of the case, this Court is of the opinion that the petitioner is not entitled for anticipatory bail. Accordingly, the criminal original petition is dismissed. 07.04.2016 kkd
