O R D E R
The petitioner has come forward with this petition seeking for a direction to transfer the investigation in Crime No.274 of 2012, pending on the file of the 1st respondent to some other police officer not below the rank of DSP with a further direction to apprehend accused persons, interrogate them and conduct further investigation and submit a final report to the competent Court, within the time stipulated by this Court.
2. The learned counsel for the petitioner would submit that the petitioner has given a complaint, which was registered on 15.04.2012 in Crime No.274 of 2012 for the offence punishable https://hcservices.ecourts.gov.in/hcservices/
under Sections 147, 148, 341, 447 and 307 IPC r/w Sections 2 and 3 of TNPPDL Act. As there was no progress in the investigation, he has come forward with the present petition for the relief stated above.
3. At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that investigation is going on and he prays for time to complete the investigation and file a final report.
4. Considering the rival submission made on both sides, this Court directs the Deputy Superintendent of Police, Mahabalipuram to monitor the investigation in Crime No.274 of 2012 and the Investigating Officer is directed to expeditiously conduct the investigation and file the final report within a period of three months from the date of receipt of a copy of this order.
5. With the above direction, this Criminal Original Petition is disposed of.
