O R D E R

(Order of the Court was made by C.V.Karthikeyan J.) This petition has been filed to condone the delay of 170 days in filing application to set aside the dismissal for non-prosecution of C.M.P. No. 24431 1/3

of 2024 on 08.01.2025. The said C.M.P. No. 24431 of 2024 had been filed to condone the delay in filing the Civil Miscellaneous Appeal against the award dated 24.08.2023 in M.C.O.P. No. 555 of 2017 on the file of the Motor Accident Special District Judge at Erode. When the aforementioned Civil Miscellaneous Petition came up for consideration, a Co-ordinate Bench has directed that a cost of Rs.1,500/- should be paid to the Legal Services Authority, Chennai, but that was not paid and therefore, the said Civil Miscellaneous Petition stood automatically dismissed. Now the application has been filed seeking to condone the delay in filing the application to restore the said petition.

2. Heard the learned counsel for the respondent, who stated that though the treatment has been taken nearly about 7 years back, no amount has been deposited and no compensation has been paid. Those arguments would be considered when the said civil miscellaneous appeal is brought on record.

3. This delay is condoned.

4. Registry is directed to list the consequential application in CMP No. 24431 of 2024 on 07.01.2026.
