The above C.M.P. is filed to condone the delay of 30 days in preferring the appeal suit.

Respondents 1 and 2 are represented by counsel. Paper publication effected in respect of respondents 4 to 6 and proof of publication has also been filed. The names of respondents 4 to 6 are also printed in the cause list. Hence, service is deemed to be complete.

Learned counsel for respondents 1 & 2 expressed "No Objection" for condoning the delay.

Having been satisfied with the reasons stated in the affidavit filed in support of the miscellaneous petition and in view of "No Objection" expressed by the learned counsel for respondents 1 and 2, the delay is condoned and the petition is ordered as prayed for.
