PRAYER: Original Petition filed under Section 372 of Indian Succession Act and Order XXV Rule 6 of O.S.Rules for grant of Succession Certificate, praying that this Hon'ble Court may be pleased to a) That the succession certificate may be granted to the petitioners with power to collect the debts and to receive the interest specified in the schedule hereto.

ORDER

The petitioners seek Succession Certificate in respect of the securities held by Late.Mrs.P.Ramani, who died intestate on 12.05.2021. The petitioners are the sisters of the deceased and her husband Late.Mr.S.Kasthuri Rangan have predeceased her on 07.07.1999, the couple 1/4

did not have any issues in the duration of their marriage.

2. The third petitioner has been examined as PW1. She has produced the computer generated death certificates of the deceased Late.Mrs.P.Ramani and husband of the deceased Late.Mr.S.Kasthuri Rangan as Ex.P3 and Ex.P1. The legal heirship certificate of the husband of the deceased Late.Mr.S.Kasthuri Rangan has been marked as Ex.P2. A perusal of Ex.P2 shows that the deceased Late.Mrs.P.Ramani did not have any issues in the duration of her marriage. A paper publication has been made which has been marked as Ex.P11 and no objections have been received.

3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.

4. In view of the above evidence, the Original Petition is allowed granting Succession Certificate in favour of the petitioners, with the power to collect the securities and receive the interest and dividends mentioned in the schedule to the petition.
