ORDER

This writ petition has been filed to restrain the respondents 1 and 2 their men, agents or any persons acting through or under any of them from in any manner interfering with the petitioners peaceful possession and business of shop of premises at Door bearing No.No.32/2 Sangeetha Sabha Building, Near Municipal Bus Stand, Vellore-4, Vellore District, comprised in TS No.322/10 in Ward No.3, Block No.15, Vellore Town and from in any manner dispossessing him from the said shop premises, except following due process of law.

2. The learned counsel for the petitioner would submit that the 3rd respondent-Sabha had leased out the subject property to the petitioner, for which, the petitioner is duly depositing the rent amount in the account of 3rd respondent. Under these circumstances, without following the due process of law, the 1st and 2nd respondents are making attempts to evict the petitioner from the subject property. Hence, this petition.

3. The learned counsel appearing for the respondent would submit that this petition has been filed by the petitioner under the apprehension that the respondents 1 & 2 are intend to evict the petitioner from their possession of the

subject land without following the due process of law. However, today, he assured before this Court that the respondents will not make any attempt to evict the petitioner from the subject land without following due process of law.

4. Heard the learned counsel for the petitioner as well as respondents and also perused the entire materials available on record.

5. The submission made by the learned counsel appearing for the respondents is recorded. The respondents 1 & 2 are directed not to evict the petitioner from the subject land without following due process of law.
