This Criminal Original Petition has been filed to take further action on the complaint given by the petitioner on 31.12.2013.

The learned counsel appearing for the petitioner submitted that the petitioner lodged a compliant in Complaint No.308/ALGSC-VLR/2013 before the respondent police alleging that the petitioner is entitled to 1/3rd share in the property belonged to her father to an extent of 6 Acres and 39 cents of the land and Preliminary Decree to that effect has also been passed and during the pendency of the said case, one Sadayan, brother of the petitioner, had created false fabricated document with regard to entire property and obtained patta in his name and also included his wife as co-owner of the property and also obtained bank loan. thereby he has committed an act of fraud, cheating and creation of false fabricated documents. On 13.02.2014, during enquiry, the accused accepted that he had committed the offence and also he gave an undertaking that he will surrender the land to the petitioner. police. Hence, this petition is filed praying to take action on her complaint.

The learned Additional Public Prosecutor would submit that the petitioner was issued CSR No.308 of 2013 and after completing enquiry on the complaint, it was closed as early as on 22.07.2013.

In view of the submission made by the learned Additional Public Prosecutor, the direction sought for in this petition cannot be granted and as such, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to lodge a fresh complaint on the fresh cause of action.
