WP No.471 of 2017 And WMP Nos.501 and 26385 of 2017 S.M.SUBRAMANIAM, J.

The learned Government Advocate appearing on behalf of the respondents brought to the notice of this Court that the order impugned has been issued by the Chief Controlling Revenue Authority and the Inspector General of Registration under Section 56(1) of the Indian Stamp Act, 1899. Against the proceedings under Section 56 of the Indian Stamp Act, Civil Miscellaneous Petition lies before the High Court.

2. The writ petition has been instituted in the year 2017 and pending for the past about six years. Thus rejecting the writ petition and granting liberty would cause prejudice to the interest of the petitioner. Hence, this Court is inclined to convert the Writ Petition as Civil Miscellaneous Appeal and accordingly, the matter is to be heard. https://www.mhc.tn.gov.in/judis

3. The Registry is directed to convert the WP No.471 of 2017 as Civil Miscellaneous Appeal and renumber the same, within a period of two weeks from today and list the matter before the appropriate Court having roster.
