This Petition has been filed under Section 218 & 278 of the Indian Succession Act, 1925 for grant of letters of administration to the Petitioners viz., Prabha Devi and K.Ashok.

2.The first Petitioner had examined himself as PW1 and settlement deed dated 07.11.1968 was marked as Ex.A1. Receipt dated 23.04.1987 was marked as Ex.A2. Land extract dated 18.09.1998 was marked as Ex.A3. Death certificate of deceased B.Krishna Rao dated 13.09.2004 was marked as Ex.A4. Legal heir certificate of Petitioners dated 19.10.2004 was marked as Ex.A5. Death certificate of deceased Indrani dated 12.02.2017 was marked as Ex.A6. Encumbrance Certificate dated 06.12.2018 was marked as Ex.A7. Property tax receipt dated 20.03.2019 was marked as Ex.A8. Town survey report was marked as Ex.A9 and paper publication was marked as Ex.A10.

3.The property in question is situated at Pilliar Koil Street, First Lane, Triplicane, Chennai 600 005, within the jurisdiction of this Court. The said property was settled in favour of the Father of the Petitioners by name 1/3

B.Krishna Rao by settlement deed dated 07.11.1968/Ex.A1. The said B.Krishna Rao died on 13.09.2014, as could be seen from death certificate of deceased B.Krishna Rao/Ex.A4. B.Krishna Rao's wife viz., K.Indrani died on 12.02.2017, as could be seen from death certificate K.Indrani/Ex.A6. As per Ex.A5, Petitioner's are the legal heirs. As on date there is no encumbrance certificate. Affidavit of service was filed by the learned counsel for the Petitioners.

4.In view of the evidence adduced, I feel there is every reason to grant the relief sought in the Original Petition namely, granting Letters of Administration tot he property and credits of the deceased B.Krishna Rao. 5.With the above observations, this Original Petition stands allowed. The Petitioners are directed to duly administer the property and credits of the deceased more fully described in the schedule. The Petitioners are directed to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) in favour of the Assistant Registrar (O.S.II) High Court, Madras. The Petitioners are further directed to render true and correct accounts once in a year.
