2. Mrs.G.Sumitra, learned counsel for the third respondent is present.
3. Taking into consideration that there was a delay in 18 days for filing the appeal.
4. Due to the medical grounds, the learned counsel for the third respondent stated that, he has also remitted balance of the sale consideration of Rs.7,50,000/- on 06.06.2023 by following the necessary procedure before the Court and he has filed Execution Petition.
5. The learned counsel for the petitioner/appellant contended that as against the very same impugned judgment, one of the defendant has filed A.S.No.479 of 2023 and the same is pending before this Court.
6. In view of the above, this petition is allowed.
7. The Registry is directed to number the Appeal Suit and post the matter during the last week of June 2024.
