The contention of the Petitioner is that he was roped in four cases viz., C.C.No.34/2011, 36/2011, 24/2016 & 10/2011.
i. C.C.No. 34/2011 ended in his favour, he was acquitted from that case. ii. C.C.No.10/2011 is a disproportionate wealth case, wherein the Petitioner was convicted along with another accused by judgment of the trial Court dated 07.10.2021, against which Crl.A.No.498 of 2021 was preferred.
iii. C.C.No.36/2011 filed for the offences under Section 120(b) IPC and 7, 8 & 13(1)(d) of Prevention of Corruption Act and is pending for trial. Now the case is at Investigating Officer's stage. iv. C.C.No.24/2016 filed for the ill-gotten money to be projected as genuine.
2.The further contention of the Petitioner is that the Appeal would take long time for disposal and the Petitioner is the sole public servant in this case 1/3
and his entire career had been spoiled because of the order of conviction in C.C.No.10/2011, which would have direct bearing in the said pending cases. The Petitioner would be put to great loss and hardship if the case in which the appeal is pending is not taken up for hearing at an early date, no prejudice would be caused to the Respondent, if the Appeal is taken on a early date fixed by this Court, on the contrary, the order of conviction would have a direct bearing on the cases pending disposal before the trial Court. 3.Mr.K.Srinivasan, learned Special Public Prosecutor for the CBI Cases submitted that in view of the Petitioner's specific submission that it might have direct bearing in the pending cases, this Appeal can be taken for final disposal. In any event, for the CBI, it is a disposal of an Appeal and has got no serious objection.
4.In view of the same, Registry is directed to make ready the typed set of papers and post it for final disposal.
