The petitioner, who was arrested and remanded to judicial custody on 20.09.2022 for the alleged offences punishable under Sections 8(c), 20(b)(ii)(B) of Narcotic Drugs & Psychotropic Substances Act, 1985 and Section 27(1) of Arms Act, 1959 in Crime No.141 of 2022, seeks bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 1.25 kilograms of Ganja, which is a intermediate quantity. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration from 20.09.2022. Hence, he prays for grant of bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.Side) would submit that, the petitioner was found in possession of 1.250 kgs of ganja and would further submit that, apart from this case, there is two previous cases pending against the petitioner. Therefore, he vehemently opposed to grant bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent.

6. Taking into consideration the submissions of the learned Government Advocate (Crl.Side) that there are two previous cases of similar in nature pending against the petitioner, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed. 20.10.2022 Sma
